General Terms and Conditions Thuiswinkel

These General Terms and Conditions of the Dutch Thuiswinkel Organization (hereinafter referred to as Thuiswinkel.org) have been established in consultation with the Consumer Association as part of the Self-Regulation Coordination Group (CZ) of the Social and Economic Council and are effective as of June 1, 2014.

Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  1. Additional agreement: an agreement under which the consumer acquires products, digital content, and/or services in connection with a distance contract, and these items, digital content, and/or services are supplied by the entrepreneur or by a third party based on an agreement between that third party and the entrepreneur;
  2. Cooling-off period: the period during which the consumer can exercise their right of withdrawal;
  3. Consumer: the natural person not acting for purposes relating to their trade, business, craft, or profession;
  4. Day: calendar day;
  5. Digital content: data produced and supplied in digital form;
  6. Continuing performance contract: a contract intended for the regular supply of goods, services, and/or digital content over a certain period;
  7. Durable medium: any tool - including email - that allows the consumer or entrepreneur to store information addressed to them personally in a way that enables future consultation or use during a period appropriate to the purpose of the information, and that allows unchanged reproduction of the stored information;
  8. Right of withdrawal: the option for the consumer to waive the distance contract within the cooling-off period;
  9. Entrepreneur: the natural or legal person who is a member of Thuiswinkel.org and offers products, (access to) digital content, and/or services to consumers at a distance;
  10. Distance contract: a contract concluded between the entrepreneur and the consumer in the context of an organized system for the distance sale of products, digital content, and/or services, using only or partially one or more techniques for distance communication up to the conclusion of the contract;
  11. Model withdrawal form: the European model withdrawal form included in Appendix I of these terms and conditions; Appendix I does not have to be provided if the consumer does not have a right of withdrawal regarding their order;
  12. Distance communication technology: means that can be used to conclude a contract without the consumer and entrepreneur needing to meet simultaneously in the same physical space.

Article 3 - Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate before the distance contract is concluded how the general terms and conditions can be inspected at the entrepreneur’s premises and that they will be sent free of charge to the consumer as soon as possible upon request.
  3. If the distance contract is concluded electronically, the text of these general terms and conditions may be provided to the consumer electronically before the distance contract is concluded, in such a way that the consumer can easily store it on a durable medium. If this is not reasonably possible, the entrepreneur will indicate before the distance contract is concluded where the general terms and conditions can be accessed electronically and that they will be sent free of charge to the consumer electronically or otherwise upon request.
  4. If, in addition to these general terms and conditions, specific product or service terms also apply, the second and third paragraphs apply mutatis mutandis, and the consumer can always invoke the applicable provision that is most favorable to them in case of conflicting terms.
